DMCA Copyright Policy
Copyright owners can ask us to remove material that copies their work. This page sets out how to do it.
1. Our position
We do not want to sell infringing material. If a product, image or other content on outloudmerch.com infringes your copyright, send us a notice as set out below. We follow the notice-and-takedown process of the Digital Millennium Copyright Act (DMCA), found at 17 U.S.C. § 512.
2. Notice contents
Send it in writing, with all six of these:
- A signature, physical or electronic, from the copyright owner or a person with authority to act on the owner’s behalf.
- The copyrighted work you claim is infringed. If the notice covers many works, a representative list of them is enough.
- The material on our site you claim infringes, described well enough for us to find it, with the URL of every page involved.
- Your contact details: name, postal address, phone number and email address.
- Your statement that you believe, in good faith, the use you are reporting lacks permission from the owner, the owner’s agent or the law.
- Your declaration, made under penalty of perjury, that the copyright is yours or that you are authorized to act for its holder, together with your statement that the notice is accurate.
3. Where to send it
Email [email protected] with the subject “DMCA Notice”, addressed to our Copyright Agent. Our full contact block is at the bottom of this page.
4. Our response
Complete notices get prompt review. When the material looks infringing, we take it down or block access to it, and we notify whoever supplied it, if anyone did.
5. Counter-notices
Believe material came down by mistake? You may file a counter-notice containing:
- A physical or electronic signature.
- The material that was removed or disabled, and where on the site it appeared before that.
- A declaration under penalty of perjury: you believe in good faith that the material came down only because of a mistake or because it was misidentified.
- Your name, address and phone number. Also state that you accept that the federal district court for the district containing your address has jurisdiction over you (for an address abroad, that court is any judicial district where Outloud Merch may be found). Last, your promise to accept service of process if the original complainant, or an agent of that person, serves it.
6. Repeat infringers
Parties who infringe repeatedly lose their material from the site and their business relationship with us.
7. Bad-faith notices
A person who knowingly makes a material false statement in a notice (that something infringes) or in a counter-notice (that something was removed by mistake or misidentification) can owe the damages that follow, including costs and attorneys’ fees, under Section 512(f) of the DMCA.
