COPYRIGHT CONCERNS

DMCA Notice

How to report a copyright concern involving content on Outloud Merch.

Outloud Merch is operated by DOANUYEN Ecom LLC. We respect intellectual property rights and review reports of alleged copyright infringement involving content available at outloudmerch.com.

This page explains our copyright reporting process and the notice and counter-notice requirements under the Digital Millennium Copyright Act (“DMCA”), where applicable. Publishing this page does not establish eligibility for any statutory limitation on liability.

1. Who should submit a copyright notice?

A copyright infringement notice should be submitted by the owner of the exclusive right involved or someone authorized to act on that owner’s behalf. Before submitting a notice, consider whether the use is authorized by a license or by law, including any applicable copyright exception.

For a product image, design, description, or other material you believe infringes your copyright, identify the specific content and provide the direct page URL. A link to our homepage alone may not give us enough information to locate the disputed material.

2. Information to include

Send a written notice with the following information:

  1. Your signature: a physical or electronic signature of the copyright owner or a person authorized to act on the owner’s behalf.
  2. The copyrighted work: identify the work you believe has been infringed. If one notice covers multiple works at a single site, provide a representative list. Include a reference link or other identifying information where available.
  3. The material on our website: identify the allegedly infringing material you want removed or disabled and provide enough information to locate it, including the direct URL of each relevant page.
  4. Your contact details: your name, mailing address, telephone number, and email address where available.
  5. A good-faith statement: state that you believe in good faith that the disputed use is not authorized by the copyright owner, its agent, or the law.
  6. An accuracy and authority statement: state that the information in the notice is accurate and, under penalty of perjury, that you are authorized to act on behalf of the owner of the exclusive right allegedly infringed.

A copyright registration number may help identify a work if you have one, but it is not required simply to submit a report through this process.

3. Where to send your notice

Email support@outloudmerch.com with the subject “Copyright Notice — Outloud Merch”. You may also send written correspondence to the business contact address below, marked “Attention: Copyright Concerns.”

These are our business channels for copyright reports. They are not represented on this page as the contact details of a registered DMCA designated agent. Formal agent designation is a separate process with the U.S. Copyright Office.

4. How we review reports

We review copyright reports promptly and may contact you for missing information or clarification. Where appropriate, we remove or disable access to disputed content. Where an applicable DMCA process requires expeditious action, we follow that process.

If the report relates to material supplied by another person, we may notify that person and share information necessary to review and respond to the claim. Removal of material does not itself determine who owns the copyright or establish that infringement occurred.

Please do not include payment information, passwords, or identity documents unrelated to your copyright claim.

5. Counter-notifications, where applicable

If material you supplied was removed or disabled under an applicable DMCA notice-and-takedown process and you believe this resulted from mistake or misidentification, you may submit a written counter-notification through the contact channel below. Identify it with the subject “Copyright Counter-Notification — Outloud Merch.”

A counter-notification must include:

  1. Your physical or electronic signature.
  2. Identification of the material removed or disabled and the location where it appeared before removal.
  3. A statement, under penalty of perjury, that you believe in good faith the material was removed or disabled because of mistake or misidentification.
  4. Your name, address, and telephone number.
  5. A statement consenting to the jurisdiction of the Federal District Court for the judicial district where your address is located. If your address is outside the United States, the statement must consent to jurisdiction in any judicial district where the service provider may be found.
  6. A statement that you will accept service of process from the person who submitted the original infringement notice or that person’s agent.

Please also provide an email address for correspondence. A counter-notification can have legal consequences, including disclosure of your contact details to the original complainant.

Where the process under 17 U.S.C. § 512(g) applies, a copy of a valid counter-notification is promptly forwarded to the original complainant. The statutory restoration period is not less than 10 and not more than 14 business days after receipt, unless notice is first received that the complainant has filed a court action seeking to restrain the alleged infringement. This process is not an automatic right to list products or restore material removed for a separate, valid reason.

6. Repeat infringement and inaccurate notices

Where user accounts or content submission features apply, our policy is to terminate access in appropriate circumstances for repeat infringers, subject to applicable law.

Knowingly making a material misrepresentation in a DMCA notice or counter-notification may result in liability under 17 U.S.C. § 512(f). If you are unsure about your rights or the required statements, consider obtaining legal advice before submitting.

7. Other concerns

The DMCA process concerns copyright. For trademark, impersonation, or other intellectual property concerns, email us with the subject “Intellectual Property Concern” and identify the right involved, relevant page links, and the basis of your complaint.

For delivery problems, damaged items, returns, or payment questions, please use our regular customer support channel and include your order number. Those requests are handled under our Shipping Info and Return & Refund Policy.

Personal information provided with a report is handled in accordance with our Privacy Policy and applicable legal requirements. Information may be shared with the affected party, professional advisers, or authorities where necessary to address the claim or comply with law.
